The Sheriff's Office holds responsive records to some, but not all, of your requests. In order to simplify the communication process, and avoid providing redundant information over multiple email threads, all of your requests have been combined into this one unified response. As previously discussed, information pertaining to law enforcement investigations is exempt from disclosure pursuant to California GC 7923.600(a). Additionally, materials held within personnel, medical, or similar files are exempt from disclosure pursuant to GC 7927.700. As previously referenced as well, 1798.90.55(B) CIV prevents the sharing or transfer of ALPR information, except to another public agency, and 7927.705 GC exempts the release of records that are prohibited from disclosure pursuant to state law. See attached responsive records 10. Records sufficient to show the total number of ALPR searches conducted by Sheriff's Office personnel, broken down by month, from program inception to the present. Records sufficient to show whether any federal agency, federal task force, federal contractor, or federal employee account has ever been granted direct or indirect access to Amador County Sheriff's Office ALPR data, including any records documenting such access, permissions, or requests. No such records exist. As previously stated, we only share info with California law enforcement agencies. 12. Records sufficient to identify all agencies, entities, or users that have accessed, queried, received alerts from, or otherwise utilized Amador County Sheriff's Office ALPR data since the program became operational. Audit logs have been provided that do not contain investigatory information. A list of agencies granted search privileges is also attached. Other specific details have been withheld as investigatory records. 13. Any records, policies, memoranda, audits, compliance reviews, or reports regarding the sharing of ALPR data with outside agencies, including any reviews of compliance with California Civil Code section 1798.90.55 and related statutes. Please provide the policy referenced in the September 13, 2023 email from Captain Jarret Benov stating, "I am preparing to push out our policy regarding license plate reader cameras and the associated software," including any drafts, prior versions, approval records, or associated memoranda. The policy manual was previously supplied, and it remains available on our website. 15. Records showing all audits, compliance reviews, policy reviews, misuse investigations, disciplinary investigations, administrative reviews, or corrective actions relating to ALPR system access, searches, alerts, or data sharing from January 1, 2023, to the present. You can refer to the audit log, otherwise there are no additional other responsive records. Misuse investigations, disciplinary investigations, and corrective actions, ifthey existed, would not be subject to disclosure as personnel records. 16. Records sufficient to identify all categories of data captured, collected, processed, stored, retained, or made available through the Flock system used by the Sheriff's Offrce, including but not limited to: o license plate images, o full vehicle images, o vehicle make, model, color, and year, o Vehicle Fingerprint data, o bumper stickers, o decals, o roof racks, o bike racks, o GPS or location information, o direction of travel, o timestamps, o video recordings, o audio recordings, o audio detections, o and any other associated metadata. Records sufficient to identify whether the Sheriff's Office utilizes Flock's Vehicle Fingerprint feature and, if so, what vehicle characteristics are captured, stored, searchable, or made available to authorized users. No responsive record exists 19. Sample screenshots, user-interface screenshots, training materials, manuals, user guides, presentations, or other records showing what information and imagery are displayed to users when viewing a vehicle read, alert, search result, or historical record. Records sufficient to identify whether the system captures: o only cropped license plate images, o full vehicle images, o multiple images of the vehicle, o front-facing images, o rea r-facing images, o side-view images, o or combination thereof. Records sufficient to identify whether any Flock device deployed by or available to the Sheriff's Office is capable of capturing, recording, storing, processing, or transmitting: o audio, o audio detections, o video, o video clips, o continuous video, o still images, o or any other visual or audio data. See attached responsive records. As previously discussed, the cameras being used in Amador County are only capturing still images. 22. Records sufficient to identify whether any audio recording, audio detection, video recording, video retention, video-search functionality, or other non-ALPR functionality is enabled, licensed, subscribed to, or available under the Sheriff's Office's agreement with Flock Safety. ACSO personnel could only access these items from other jurisdictions if shared by the agency. 23. Records sufficient to identify how images are generated by the system, including whether images are captured as still photographs, extracted from video, generated from buffered video, or created through any other method. Policy 473.5 of the Sheriff's Office Policy Manual states that: 'All ALPR data downloaded to the server should be stored for a minimum of one year." However, the Sheriff's Office's response to my prior request stated that captured license plate images are retained for 30 days by default. Please provide records sufficient to explain this apparent difference and identify: a. What categories of information are retained for 30 days; b. What categories of information are retained for one year or longer; c. Whether any ALPR data is downloaded, copied, exported, synchronized, archived, or otherwise transferred from Flock systems to Sheriff's Office systems or other storage systems; d. The retention period applicable to any downloaded, exported, synchronized, archived, or locally stored ALPR data; and e. Any policies, procedures, agreements, manuals, training materials, or technical documents governing ALPR data retention, deletion, archival, export, synchronization, or purging See attached responsive records.
