Sex Offender Supervision and Compliance

Pursuant to the California Public Records Act, I am requesting records concerning Amador County Probation Department's supervision and monitoring of individuals who are required to register as sex offenders under Penal Code section 290.

I am seeking the following records:

1. All current policies, procedures, manuals, directives, guidelines, or other written materials governing the supervision of adult probationers who are required to register under Penal Code section 290.

2. Records describing or establishing the frequency or type of contact required or expected with these probationers, including office visits, telephone or electronic contacts, field contacts, home visits, residence verification, compliance checks, or similar supervision activities.

3. Policies, procedures, or guidelines concerning verification of a probationer's residence or registered address, including home visits, residence checks, compliance checks, or procedures used when there is reason to believe an individual is not residing at the address they have provided.

4. Policies, manuals, guidelines, or criteria used to determine the level or intensity of supervision for individuals convicted of sex offenses, including any risk-assessment tools or classifications used by the Department. I am seeking the policies and methodology, not confidential individual assessment records.

5. Standard, model, or commonly used probation conditions applicable to individuals convicted of sex offenses, including conditions concerning:

   • contact with minors;

   • schools, daycares, playgrounds, parks, or other locations where children regularly congregate;

   • residence restrictions;

   • internet or social-media use;

   • treatment or counseling;

   • polygraph examinations;

   • GPS or other electronic monitoring; and

   • search or compliance conditions.

6. Policies, procedures, or protocols concerning how the Department responds when a supervised individual who is required to register under Penal Code section 290 is suspected of:

   • failing to register or update registration information;

   • providing a false or inaccurate residence address;

   • violating a condition of probation; or

   • otherwise failing to comply with sex-offender-related supervision requirements.

7. Any current memoranda of understanding, agreements, written protocols, operating procedures, or similar records concerning coordination between the Probation Department and the Amador County Sheriff's Office, District Attorney's Office, local police departments, California Department of Corrections and Rehabilitation/Division of Adult Parole Operations, or other agencies concerning registered sex offenders, sex-offender compliance checks, residence verification, or supervision.

8. Records sufficient to identify any coordinated sex-offender compliance operations, residence-verification operations, sweeps, or similar activities conducted by or involving the Probation Department from January 1, 2023 through the date of the search, including the date of the operation and participating agencies. Summary reports, after-action reports, statistical summaries, or similar records are sufficient for this portion of the request.

9. To the extent this information is maintained in existing reports, spreadsheets, databases, dashboards, case-management reports, or other records, records sufficient to show, for each calendar year from January 1, 2023 through the date of the search:

   • the number of individuals required to register under Penal Code section 290 who were supervised by Amador County Probation;

   • the number of home visits, residence checks, or compliance checks involving those individuals;

   • the number of probation violations involving those individuals; and

   • the number of matters referred to another law-enforcement agency or the District Attorney for suspected registration or supervision violations.

I am not asking the Department to create a new statistical record if these figures are not presently maintained. If existing electronic records contain this information, please provide those existing records in their native electronic format where reasonably available.

10. From January 1, 2020 through the date of the search, any nonprivileged reports, memoranda, presentations, proposals, correspondence, studies, or policy materials concerning whether Amador County may impose or seek additional lawful restrictions on higher-risk sex offenders, particularly offenders whose victims were children, concerning residence near or presence at schools, daycares, playgrounds, parks, or other places where children regularly congregate.

This request is primarily intended to understand Amador County's policies and practices rather than obtain confidential information concerning particular probationers. I am not requesting victim information, Social Security numbers, medical information, or other similar private personal information. If a responsive record contains exempt information, please redact only the exempt portion and produce the reasonably segregable remainder.

Please provide responsive records electronically by email or download link. For records maintained as spreadsheets, databases, CSV files, or similar electronic records, please provide them in their original or native electronic format where reasonably available.

If any portion of this request is denied or withheld, please identify the specific statutory basis for each withholding and provide all reasonably segregable nonexempt portions of the responsive records.
