Sex Offender Registration, Compliance, and Enforcement

Pursuant to the California Public Records Act, I am requesting records concerning the Amador County Sheriff's Office's responsibilities and practices relating to individuals required to register as sex offenders under Penal Code section 290.

I am seeking the following records:

1. All current policies, procedures, manuals, directives, guidelines, training materials, or other written materials governing the registration, monitoring, verification, compliance checking, or enforcement of requirements applicable to registered sex offenders within the Sheriff's Office's jurisdiction.

2. Records describing the Sheriff's Office's procedures for receiving, processing, updating, or verifying sex offender registrations, including changes of address, annual or periodic registration requirements, transient registrations, and other required registration updates.

3. Policies, procedures, guidelines, or written protocols concerning verification that a registered sex offender actually resides at the address provided to the Sheriff's Office, including residence checks, home visits, field contacts, database checks, compliance checks, or other verification methods.

4. Records establishing whether residence verification or compliance checks are conducted on a routine or periodic basis and, if so, any policies or guidelines concerning:

   • how frequently checks are performed;

   • which registrants are prioritized;

   • whether frequency varies based on risk level, offense history, victim age, supervision status, or other factors; and

   • which Sheriff's Office personnel or units are responsible for conducting those checks.

5. Policies, procedures, protocols, or guidelines concerning suspected violations of Penal Code section 290 or related registration requirements, including:

   • failure to register;

   • failure to update an address or other required information;

   • providing a false or inaccurate address;

   • failure to complete required periodic registration; and

   • situations in which the Sheriff's Office is unable to locate or verify the residence of a registrant.

6. Records sufficient to show the Sheriff's Office's procedures for referring suspected registration violations for investigation, arrest, prosecution, probation action, parole action, or review by the District Attorney.

7. Any current memoranda of understanding, agreements, written protocols, operating procedures, or similar records concerning coordination between the Sheriff's Office and:

   • Amador County Probation Department;

   • Amador County District Attorney's Office;

   • California Department of Corrections and Rehabilitation, including the Division of Adult Parole Operations;

   • local police departments; or

   • any other law-enforcement agency

regarding registered sex offenders, residence verification, compliance checks, registration violations, or supervision of individuals convicted of sex offenses.

8. Records sufficient to identify any sex offender registration compliance operations, residence-verification operations, sweeps, task-force operations, or similar enforcement activities conducted by or involving the Sheriff's Office from January 1, 2023 through the date of the search.

For each operation, records sufficient to show the date, participating agencies, number of registrants checked, and number of suspected violations, arrests, citations, referrals, or other enforcement actions are sufficient. Summary reports, after-action reports, statistical summaries, press materials, or similar records are sufficient for this portion of the request.

9. To the extent the following information is maintained in existing reports, spreadsheets, databases, dashboards, case-management systems, or other records, records sufficient to show for each calendar year from January 1, 2023 through the date of the search:

   • the number of registered sex offenders within the Sheriff's Office's registration jurisdiction;

   • the number of residence-verification or compliance checks conducted;

   • the number of registrants who could not be located or whose residence could not initially be verified;

   • the number of suspected Penal Code section 290 violations identified;

   • the number of arrests, citations, reports, or referrals resulting from suspected registration violations; and

   • the number of matters referred to the District Attorney, Probation Department, CDCR, or another agency.

I am not asking the Sheriff's Office to create a new statistical record if these figures are not presently maintained. If existing electronic records contain this information, please provide those existing records in their native electronic format where reasonably available.

10. Any policies, training materials, memoranda, presentations, correspondence, proposals, studies, or other records from January 1, 2020 through the date of the search concerning restrictions or enforcement measures applicable to registered sex offenders near schools, daycares, playgrounds, parks, or other locations where children regularly congregate.

11. Any records from January 1, 2020 through the date of the search concerning consideration of additional local policies, ordinances, enforcement practices, supervision measures, or other lawful restrictions intended to protect children from individuals convicted of sex offenses.

This request is intended to understand the Sheriff's Office's policies, practices, enforcement activity, and coordination with other agencies. I am not requesting victim identities, Social Security numbers, medical information, confidential juvenile information, or other similarly private personal information.

I am also not requesting confidential details from individual registrant files where disclosure is prohibited by law. If responsive records contain exempt information, please redact only the exempt portions and produce all reasonably segregable nonexempt portions.

Please provide responsive records electronically by email or download link. For records maintained as spreadsheets, CSV files, databases, or other electronic records, please provide them in their original or native electronic format where reasonably available.

If any portion of this request is withheld, please identify the specific statutory basis for each withholding and provide all reasonably segregable nonexempt portions of the responsive records.
