What the transcript adds

The Chair opens public comment expressly for matters not on the agenda. After that period closes, the Board approves the day’s agenda and then immediately approves the consent calendar 5–0. The transcript contains no separate invitation for public comment on consent items between those votes.
This sequence raises a possible compliance question because Government Code § 54954.3 requires an opportunity to address a legislative body on an agenda item before or during consideration, and Civil Code § 1798.90.55(a) requires a public-comment opportunity before a public agency implements an ALPR program. The archive does not make a final legal determination because an earlier qualifying public meeting, separate procedure, or other relevant facts could affect the analysis.

August 2026 Board acknowledgment
At the August 11, 2026 Flock discussion, Chairman Patrick Crew said the Board could “probably” agree the program should not have been on consent at the time. The transcript records an audible agreement. The Board later rejected a motion to cancel the contract 2–3 but voted 5–0 to bring the program back as a regular agenda item near renewal.
